Section 26 of the Leadership Code Act is all about making sure government leaders do not misuse their position and power when it comes to awarding of government contracts. It’s a provision that helps keep things fair, open, and free from corruption.
This section says that leaders are not allowed to have or try to get any personal benefit from a contract with the government — important conditions are followed:
- Fair Dealings: The contract must be done in a fair, open, and proper way, like any normal business deal.
- Follow the Law: The contract must follow all laws made for that purpose.
- Proper Tender Process: If the deal involves the government, a government department, or a government-owned company, it must go through a proper bidding process (called a tender).
These rules are designed to stop leaders from using their position for personal gain. They make sure contracts go to the right people for the right reasons.
This rule applies to all leaders, including:
- Members of Parliament
- Heads of government departments
- Senior public servants
If a leader doesn’t follow Section 26, they could be charged with misconduct under Vanuatu’s law about leadership responsibilities. This helps protect the public and maintain trust in the government.
